CLASS ACTION SUIT AGAINST GONZALES, INC, SISTEMA INTERNACIONAL DE TRANSPORTE DE AUTOBUSES, INC., and GREYHOUND LINES, INC.

On December 18, 2002 a complaint initiating the contemplated adversary proceeding was filed in the Bankruptcy Court in Phoenix. The Plaintiffs now include not only the Plaintiffs in the original suit in the Federal Court in Los Angeles but, in addition, Edward Barajas, Jose Jimenez Jr., Jose Morales, Alfredo Nava, Teresa Nava, Felix Novoa, Brenda Porras, Ricardo Rodriguez, Francisco Zamora, all suing on behalf of themselves and others similarly situated. The class has been expanded to include all former employees of Golden State Transportation who were laid off at various times in August, 2002. The Defendants remain Gonzalez, Inc., Greyhound Lines, Inc., and Sistema Internacional de Transporte de Autobuses, Inc. December 5, 2002 :

On November 12, 2002 the Law Offices of Bennett Rolfe filed an action in the United States District Court in Los Angeles on behalf of Jimmy Rice, Manuel Paz, Cesar Barrios, Manuel Reygosa and Simon Rosales and all others who like those persons were laid off from their jobs at Golden State Transportation in the greater Los Angeles area on August 29 or 30, 2002.

The action was based on an alleged violation of the Worker Adjustment and Retraining Notification Act, popularly known as the WARN act, which requires some employers to give 60 days notice of certain types of lay-offs and provides for recovery of up to 60 days pay in the absence of such notice.

The Defendants in the action are Gonzalez, Inc. and its parent companies Sistema Internacional de Transporte de Autobuses, Inc. and Greyhound Lines, Inc.

Shortly after the filing of the action it was learned that Gonzalez, Inc. had filed a Chapter 11 bankruptcy petition in the Bankruptcy Court in Phoenix, Arizona. Accordingly, the case is to be heard in a so-called adversary proceeding to be filed against all the Defendants in the Bankruptcy Court in Phoenix.

On December 2,  2002, the nationally recognized New York law firm of Lankenau and Miller as cooperating counsel for the Maurice and Jane Sugar Law Center in Detroit agreed to associate with the Law Offices of Bennett Rolfe in pursuit of the WARN claim which was filed.
